These Terms of Service govern your use of StaffCurrent.

StaffCurrent is operated by Brian Kennedy, a sole proprietor in Missouri, United States. “StaffCurrent,” “we,” and “us” refer to that business. “You” refers to the organization using the service.

By creating an account, subscribing to StaffCurrent, or otherwise using the service, you agree to these terms and the Privacy Policy. If you are accepting these terms for an organization, you confirm that you have authority to do so.

1. The service

StaffCurrent helps organizations record credential expiration dates and receive reminders about upcoming expirations.

StaffCurrent is a reminder and recordkeeping service. It does not verify the accuracy or validity of credentials, determine whether a person is qualified to work, or guarantee compliance with licensing, accreditation, regulatory, employment, or other requirements.

You are responsible for the information entered into StaffCurrent and for determining whether your organization and its people remain compliant with applicable requirements.

StaffCurrent is not a document-storage service and is not designed to store protected health information, Social Security numbers, medical records, personnel files, background-check reports, or similar sensitive records.

2. Your account

You are responsible for maintaining control of the email account used to access StaffCurrent and for activity performed through your StaffCurrent account or renewal links.

You must notify us promptly if you believe your account or access links have been compromised.

3. Your data

You retain responsibility for the information you enter into StaffCurrent.

You grant us permission to store, process, transmit, and back up that information as necessary to provide and maintain the service.

You represent that you have the right to provide the information you enter into StaffCurrent and that your use of the service complies with your obligations to the people whose information you enter.

Our handling of personal information is described in the Privacy Policy.

4. Payment and cancellation

Paid subscriptions renew automatically until cancelled. The price and billing period are shown before you subscribe.

Payments are processed by Stripe.

You may cancel at any time through the billing page. Cancellation stops future renewals, and your paid access continues through the end of the current billing period.

If you request a refund within 30 days of your first payment, we will provide a full refund. Refunds after that period are at our discretion except where otherwise required by law.

We may suspend access if payment is overdue.

5. Acceptable use

You may not:

  • attempt to access another organization’s account or data;
  • interfere with, probe, overload, or disrupt the service;
  • use automated access or scraping in a way that burdens the service;
  • resell or sublicense access to StaffCurrent without permission;
  • use the service for unlawful purposes; or
  • knowingly enter information that StaffCurrent is not designed to store.

We may suspend or terminate access for violations of these terms, misuse of the service, or activity that threatens the security or availability of StaffCurrent or its users.

6. Availability and changes

StaffCurrent is provided without an uptime or availability guarantee.

The service may occasionally be unavailable because of maintenance, software errors, infrastructure failures, third-party services, or other circumstances.

Features may be added, changed, or removed over time. We will provide reasonable notice before making a material change that significantly reduces the paid service.

7. No warranties

To the fullest extent permitted by law, StaffCurrent is provided “as is” and “as available,” without warranties of any kind, express or implied.

We do not warrant that StaffCurrent will always be available, error-free, or uninterrupted, or that reminders or other emails will always be delivered.

You remain responsible for independently determining whether credentials are current and whether your organization satisfies its legal, regulatory, contractual, and professional obligations.

8. Limitation of liability

To the fullest extent permitted by law, StaffCurrent and Brian Kennedy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the service.

This includes losses resulting from missed or inaccurate expiration dates, undelivered reminders, credential lapses, regulatory findings, fines, lost revenue, or business interruption.

To the fullest extent permitted by law, our total liability arising from StaffCurrent will not exceed the amount you paid for the service during the 12 months immediately before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

9. Claims arising from your use

You are responsible for claims arising from information you provide to StaffCurrent, your violation of these terms, or your unlawful use of the service.

To the extent permitted by law, you agree to indemnify and hold StaffCurrent and Brian Kennedy harmless from third-party claims, damages, liabilities, and reasonable costs resulting from those actions.

10. Ending your use of StaffCurrent

You may stop using StaffCurrent or cancel your subscription at any time.

We may suspend or terminate the service for nonpayment, violation of these terms, security concerns, unlawful activity, or circumstances that make continued operation of the service impractical.

Where reasonably possible, we will provide notice and an opportunity to export your data before permanently terminating your account.

Deletion and retention of account data are governed by the Privacy Policy.

11. General terms

These terms and the Privacy Policy constitute the agreement between you and StaffCurrent concerning the service.

If any provision of these terms is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights under these terms without our consent. We may transfer these terms in connection with a sale, transfer, or reorganization of StaffCurrent.

We are not responsible for delays or failures caused by circumstances reasonably outside our control.

12. Governing law

These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Any dispute arising from these terms or StaffCurrent will be brought in the state or federal courts located in Missouri, and each party consents to jurisdiction there.

13. Changes to these terms

We may update these terms from time to time.

If we make a material change, we will provide reasonable notice before it takes effect. Continued use of StaffCurrent after the effective date of updated terms constitutes acceptance of them.
